Throughout these Terms, “GearTCG”, “we”, “us” and “our” refer to the operator of geartcg.com. “You” and “your” refer to any visitor, customer or user of the website.

By accessing or using geartcg.com, you agree to these Terms of Service. If you place an order, our Terms & Conditions, Shipping & Returns Policy, Pre-Order Policy and any product-specific terms shown before checkout also apply.

Nothing in these Terms limits any mandatory rights granted to consumers under applicable law.

2. Scope of These Terms

These Terms apply to all visitors and users of geartcg.com. They set out the rules for using the website and its online features.

Purchases are governed primarily by our separate Terms & Conditions. Shipping, returns and pre-orders are also governed by their respective policies. If there is a conflict concerning a purchase, the more specific sales or product term will apply, subject to mandatory law.

3. Acceptance and Eligibility

You may use the website only if you can lawfully agree to these Terms. If you are under the age of legal majority in your country, you must use the website under the supervision or with the authorisation of a parent or legal guardian.

We take reasonable care to keep product descriptions, prices, availability, release information and other website content accurate. However, typographical errors, technical issues, inventory discrepancies or supplier changes may occasionally occur.

Product images may be illustrative, particularly before an official release. Manufacturers may change packaging, artwork, contents or specifications without prior notice. Colours and visual details may also vary depending on the device or screen used.

If an error affects an order, it will be handled under our Terms & Conditions and applicable consumer law.

7. Orders and Purchases

Using the website or adding a product to a cart does not guarantee availability or create a sales contract. Order formation, pricing, payment, availability, purchase limits, cancellation, delivery, withdrawal rights, legal guarantees and refunds are governed by our Terms & Conditions and related policies.

8. Pre-Orders

Products offered before their release are subject to our Pre-Order Policy. Release dates and expected arrival dates may change because of decisions or delays involving publishers, manufacturers, distributors, carriers, customs authorities or other parties outside our reasonable control.

A displayed release date is not a guaranteed delivery date. Please read the Pre-Order Policy before placing a pre-order.

9. Authentic Products and Randomised Contents

GearTCG sells genuine products sourced through trusted distribution channels. We do not knowingly sell counterfeit, reproduced or unofficial cards as authentic ONE PIECE Card Game products.

Trading card products may contain randomised contents. Unless an outcome is expressly guaranteed by the manufacturer and stated on the relevant product page, no particular card, rarity, artwork, pull rate, market value or grading result is guaranteed.

10. Permitted Use

You may use geartcg.com for lawful personal shopping, product research, account management and communication with GearTCG.

You may view and temporarily store website content as technically necessary for ordinary browsing. Any other reproduction, publication, distribution, modification or commercial exploitation requires prior permission unless permitted by law.

11. Prohibited Use

You must not use the website to:

  • violate any applicable law or third-party right;

  • commit or facilitate fraud, payment abuse or unauthorised chargebacks;

  • submit false, deceptive or misleading information;

  • impersonate another person or falsely claim an affiliation;

12. Intellectual Property Belonging to GearTCG

Unless otherwise stated, the original text, layout, design elements, branding and other materials created for geartcg.com are owned by or licensed to GearTCG and are protected by applicable intellectual property laws.

No licence is granted except the limited right to access and use the website in accordance with these Terms. You may not use the GearTCG name, logo, website content or branding for commercial purposes without prior written permission.

13. Independent Retailer and Third-Party Rights Disclaimer

GearTCG is an independent retailer. GearTCG is not affiliated with, sponsored by, endorsed by or officially connected with Bandai, Bandai Namco, the ONE PIECE franchise or any associated rights holder, licensor, publisher, studio, creator, distributor or affiliate.

ONE PIECE, ONE PIECE CARD GAME and all related names, characters, logos, artwork, card designs, product images and trademarks are the property of their respective owners. Their appearance on geartcg.com is solely for the lawful identification, description and resale of genuine products and does not imply any official partnership, approval or endorsement.

References to third-party brands do not grant GearTCG or website users any ownership of those rights.

14. Reviews and User Content

Where the website allows reviews, comments or other submissions, you must provide content that is honest, lawful and relevant. You must not submit content that is defamatory, threatening, discriminatory, deceptive, infringing, promotional spam or harmful to another person’s privacy.

You confirm that you have the necessary rights to submit your content. You grant GearTCG a non-exclusive, worldwide, royalty-free licence to display, reproduce and format that content solely for operating, promoting and improving the website and services, subject to applicable law.

We may moderate or remove content for legitimate legal, security or platform-integrity reasons. A genuine review will not be removed solely because it is critical.

The website may use or link to services operated by third parties, including payment providers, delivery companies, review platforms and social networks. Those services may have their own terms and privacy policies.

A link or technical integration does not mean that GearTCG controls or endorses all content or practices of the third party. The website and its content are provided with reasonable care for general shopping and informational purposes. We do not guarantee uninterrupted access, the absence of every technical error or the future availability of any product.

Information about card rarity, pull rates, grading outcomes, market prices, investment potential, tournament legality or future collectable value is not financial or professional advice and is not guaranteed unless expressly stated as an official manufacturer specification.

Nothing in this section excludes the obligation to supply products in conformity with the sales contract or any other mandatory consumer protection.

20. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, wilful misconduct, gross negligence, personal injury caused by negligence or mandatory consumer rights and guarantees.

Subject to those protections, GearTCG is not responsible for indirect or unforeseeable losses arising solely from use of or inability to use the website, or for losses caused exclusively by a third party outside our reasonable control.

GearTCG is not responsible for changes in the resale value of collectables, unofficial pull-rate expectations, grading decisions, tournament results or investment decisions made by a user.

21. Changes to the Website or These Terms

We may update the website and these Terms to reflect legal, security, technical, operational or commercial changes. The latest version will be published on this page with a revised “Last updated” date.

Changes apply to future website use from the date they are published. They do not retroactively change an existing sales contract unless required by law or expressly agreed with the customer.

22. Severability and No Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. The affected provision will be interpreted or replaced only to the minimum extent necessary to make it lawful and enforceable.

Failure to enforce a provision immediately does not waive the right to enforce it later.

23. Governing Law and Jurisdiction

These Terms are governed by French law.

For consumers, this choice does not deprive you of mandatory protections granted by the law of the country in which you habitually reside. Disputes may be brought before the courts competent under applicable consumer and procedural law.

For business users only, and where legally permitted, disputes fall within the jurisdiction of the competent courts of Paris, France.
